Posting again on this topic, the NSA wire taps have by the Bush Administration been called legal, but according to a Washington Post article, "The Bush administration appears to have violated the National Security Act by limiting its briefings about a warrant less domestic eavesdropping program to congressional leaders, according to a memo from Congress's research arm released yesterday."
The ACLU has also filed a suit challenging the Bush Administration on the constitutionality of the wiretaps. According to the Miami Herald other "Plaintiffs include authors and journalists James Bamford, Christopher Hitchens and Tara McKelvey, as well as the National Association of Criminal Defense Lawyers, Greenpeace and the Council on American Islamic Relations."
The Bush administration had NO RIGHT to wiretap AMERICAN CITIZENS without a wire tap. As I have previously stated he could have gotten a FISA court order. They are totally classified and cannot be released to the public. So if Bush doesn't even want to tell them about it, than it must be crossing a clear line between security and civil liberties. This lawsuit could be very important and will be a challenge for both sides.
