NSA Still An Issue

A new sign of trouble for the Bush administration is an a former associate deputy attorney general, David S. Kris, saying that the government's justification of warrantless wiretaps is weak and would not be supported by the court system. In response to the comments by Mr. Kris, Justice Department spokesman Brian Roehrkasse said that "it is not new that there are some who have disagreed with this analysis." Mr. Roehrkasse went on to say that "Numerous lawyers with knowledge of the terrorist surveillance program have concluded that the program is being conducted in accordance with the law."

The government cannot just dismiss arguments against its case. The case against the NSA warrantless wiretaps is strong and the current administration is taking much heat from the public and some of its own supporters. The current system has been revealed and the government cannot just cry foul and say it is their right to do this. The government must be accountable for its actions. If that means bring this before court, than so be it. The case would most likely go up to the US Supreme Court and it would finally bring to rest the constitutionality of this issue. That is what the court system does right?!?! Let the courts do the job they are meant to and let the other branches do their duties.

A lawsuit, huh? Let's think how it would work. To file a lawsuit, someone has to claim that he has been harmed. In this case, a citizen would have to claim that the NSA bugged a call to him from a foreign country, and that the bugging caused him some harm. The harm could be lost wages, humiliation, ill health, or something else like that. Then once the trial began, he would have to convince the judge that the nameless, faceless beaurocrat in the NSA who did the bugging knew that the wiretapping was likely to cause such harm. Then if the citizen were to win, the government (i.e., taxpayers) would pay him a million dollars and he would live happy ever after.
